These Terms of Service ("Terms") govern your access to and use of voltarigear.com and any related services (the "Site"), operated by Voltari Gear ("we", "us", "our"). By browsing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to place an order. By ordering, you confirm that you meet this requirement and that the information you provide is accurate and complete.

2. The Site and its content

All content on the Site — text, product descriptions, photographs, graphics, logos, and page layouts — is owned by us or used with permission, and is protected by applicable intellectual property laws. You may not copy, reproduce, republish, or distribute any part of the Site for commercial purposes without our written consent.

Product names and trademarks belonging to third parties are the property of their respective owners. Any reference to them is descriptive only and does not imply affiliation or endorsement.

3. Products

We work to describe our products accurately, including specifications supplied to us by manufacturers. Even so, colours and finishes can appear differently depending on your screen, and packaging or minor design details may change without notice.

Product specifications are provided as a guide. If a particular measurement, compatibility question, or specification matters to your purchase, email us before ordering and we will confirm it.

We reserve the right to limit quantities, discontinue any product, or decline to sell to any person, at any time.

4. Pricing

All prices are in US dollars and include standard shipping. There are no shipping charges, handling fees, import duties, or customs charges on any order — our products ship from warehouses inside the United States. Sales tax is calculated and applied at checkout where required by law.

Prices may change at any time. The price that applies to your order is the price displayed at the moment you complete checkout.

We do not display "compare at" or former prices, and we do not run countdown timers or artificial scarcity messaging.

5. Orders and acceptance

Your order is an offer to buy. We accept it when we send you a confirmation email. Until then, no contract exists between us.

We may decline or cancel an order for any lawful reason, including where a product is unavailable, where a price or description was published in error, where we suspect fraudulent or unauthorised activity, or where an order appears intended for resale. If we cancel an order you have already paid for, we will refund it in full.

6. Errors and inaccuracies

Occasionally information on the Site may contain typographical errors, inaccuracies, or omissions relating to prices, descriptions, availability, or delivery estimates. We reserve the right to correct such errors and to update information at any time without prior notice, including after you have submitted an order.

7. Payment

Payment is processed through PayPal, which handles all card and account details directly. We do not receive, store, or have access to your full payment card information.

By submitting payment details you confirm you are authorised to use the payment method. Orders are not dispatched until payment has cleared.

We cannot accept payment details sent by email, invoices, purchase orders, or net terms.

8. Shipping and delivery

We ship within the United States only, including Alaska, Hawaii, and APO/FPO addresses. Orders are prepared for dispatch within 1–2 business days and typically arrive 6–12 business days after ordering.

Delivery windows are estimates, not guarantees. Carrier delays, weather, and seasonal volume can extend them. Full details are in our Shipping Policy, which forms part of these Terms.

Risk of loss passes to you on delivery to the address you supplied. Where a parcel does not arrive, our Refund Policy sets out how we handle it.

9. Address accuracy

You are responsible for the accuracy of the shipping address entered at checkout. We can correct an address within 24 hours of ordering if you email us. Once an order has shipped it cannot be rerouted, and parcels delivered as addressed to an incorrect address are not eligible for refund.

10. Cancellations, returns, and refunds

Cancellation requests are handled in accordance with our Refund Policy, which forms part of these Terms and sets out what is covered, how to make a claim, and how refunds are issued.

11. Product use and safety

Our products are intended for ordinary consumer use. Follow any instructions or warnings supplied with a product. Do not modify, disassemble, or use a product for a purpose it was not designed for.

Products containing small parts, batteries, magnets, or moving components are not suitable for young children and should be kept out of their reach. We are not responsible for injury, damage, or loss arising from misuse, unauthorised modification, or use contrary to supplied instructions.

12. Accounts

If you create an account, you are responsible for keeping your credentials confidential and for all activity that occurs under your account. Tell us promptly if you believe your account has been used without your authorisation.

13. Acceptable use

You agree not to use the Site to break any law; to submit false or misleading information; to upload malicious code; to attempt to gain unauthorised access to the Site or its related systems; to scrape or harvest data by automated means; to interfere with the security or operation of the Site; or to harass, abuse, or harm any person.

We may terminate your access to the Site for breach of these Terms.

14. Communications

When you place an order or contact us, you agree that we may reply by email regarding your order, your enquiry, and your relationship with us. Marketing emails, if we send any, will always include a way to unsubscribe.

15. Feedback and submissions

If you send us comments, suggestions, reviews, photographs, or other material, you grant us a non-exclusive, royalty-free right to use, reproduce, and publish it in connection with our business. You confirm the material is your own, is accurate, and does not infringe anyone else's rights. We are under no obligation to keep submissions confidential, to pay for them, or to respond to them.

16. Third-party links

The Site may link to third-party websites or services that we do not control. We are not responsible for their content, accuracy, products, or practices. Any dealings you have with a third party are between you and that third party.

17. Disclaimer of warranties

The Site and the products sold through it are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defect will be corrected.

Nothing in these Terms limits any warranty or right that cannot be excluded under applicable law.

18. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of use, arising out of or relating to your use of the Site or any product purchased through it.

Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Some jurisdictions do not allow the exclusion or limitation of certain damages. Where that is the case, the above applies to the maximum extent permitted.

19. Indemnification

You agree to indemnify and hold us harmless from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

20. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, carrier disruption, labour disputes, power or network failures, or government action.

21. Severability and waiver

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will continue in full force. Our failure to enforce any right or provision is not a waiver of it.

22. Governing law

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict of law rules. Nothing in this section deprives you of the protection of any mandatory consumer law of your place of residence.

23. Changes to these Terms

We may update these Terms at any time by posting a revised version on this page and updating the date above. Changes take effect when posted. The version in force at the time you place an order governs that order. Please review this page periodically.

24. Entire agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, form the entire agreement between you and us regarding your use of the Site, and supersede any prior agreements or understandings.
